The man who was the baby on Nirvana's iconic Nevermind album cover in 1991 is now suing the band for child sexual exploitation.
Spencer Elden, who famously recreated the cover photo in 2016 for the album's 25th anniversary, isn't celebrating Nevermind's 30th, TMZ reports.
According to a federal lawsuit, Elden claims he could not consent to his image being used on the album art when he was just four months old. He says his legal guardians didn't consent to it either.
He claims the album cover amounts to child pornography and that the band promised to cover his genitals with a sticker, but never followed through.
Elden says Kurt Cobain, Krist Novoselic and Dave Grohl failed to protect and prevent him from being sexually exploited and he says the album cover caused him to suffer lifelong damages.
His lawsuit names Novoselic, Grohl and Cobain's estate as defendants and he wants them each to pay him at least $150,000 in damages.
Nirvana has yet to comment on the lawsuit.
Nevermind has sold over 30 million copies since its release in September of 1991. But band was a long way from the top of the charts when the album cover photo was taken in early 1991 by Kirk Weddle, a friend of Elden's parents. They were reportedly paid $200.
Elden has recreated the cover photo at least four times, including for the album's 10th, 17th, 20th and 25th anniversaries.
